If the cardholder does not pay this amount immediately, the bank will temporarily block the card until the overage status is no longer present. In the event that the 60-day period has expired and the causes or omission of a party are not identified, the bank and the cardholder must agree on a solution within the next 15 working days (or other legal deadlines provided from time to time). If the parties do not reach an agreement or if one of the parties does not agree with the procedure for handling inquiries or complaints, the dispute will be resolved in accordance with the applicable regulations. If the Bank issues an Additional Card at the joint request of the Cardholder and the Additional Cardholder, the Additional Cardholder will be bound by the terms of this Agreement and will be responsible for the use of the Additional Card. Notwithstanding the foregoing, the Primary Cardholder remains responsible for the use of their Card and the Additional Card. The Bank shall, in its sole discretion, collect all charges incurred for the Additional Card from the Primary Cardholder or the Additional Cardholder, or both. With respect to clause 10.1 below relating to the cancellation of an Additional Card, the Cardholder may be liable for all payments resulting from the use of the Additional Card until it has been returned or until the Bank is able to apply the procedures applicable to Lost Cards if the Cardholder (primary or additional) so requests. The additional cardholder is not responsible for the use of the card by the primary cardholder or the use of any other additional card by another additional cardholder.  If the validity of the Card remains less than twenty-four (24) months and the Card does not make any transactions in the last twelve (12) consecutive months, the Card will not be renewed on the Card Expiry Date. Each credit card installment payment plan is subject to the terms and conditions applicable to the plan, which are available at merchant points where cardholders request the plan. In the event of any conflict between these Terms and the terms contained herein, the former shall prevail. 19.3 Recording of verbal instructions or communications The Bank reserves the right to destroy documents relating to the card account after microfilming.

(c) The Bank may, on behalf of such HSBC Member, collect funds due and payable by the Cardholder in connection with or in connection with the HSBC Premier Credit Card issued by such HSBC Member to the Cardholder. Force majeure events are events that have occurred outside the Bank`s control, that are unforeseen, that cannot be avoided, that directly cause loss and damage to the Bank and the Bank`s ability to fulfill its obligations to the Client.
